Safeway Recall Notice Consumer Class Action

Daniel T. LeBel filed a class action lawsuit with the Center for Science in the Public Interest and Mehri & Skalet PLLC against Safeway, Inc. for its failure to notify Club Card members who have purchased recalled food.

Safeway collects customer purchase information through its Club Card program then uses it for its own marketing purposes. Plaintiffs brought this action to ensure that when Safeway knows a particular customer bought food subject to a Class I recall, Safeway will inform the person of the recall and the consumer's right to a refund. The federal goverment issues Class I recalls for food that, if consumed, has a substantial liklihood of causing injury or death.
